These Terms and Conditions (“Terms”) govern your access to and use of https://halfskull.com (the “Website”) and every purchase you make on it. The Website is owned and operated by HALFSKULL APPARELS LLP, a Limited Liability Partnership registered in India, which sells streetwear and oversized t-shirts under the brand Half Skull / Halfskull (“Halfskull”, “we”, “us” or “our”). “You” or “customer” means any person who visits the Website or places an order.

By using the Website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping and Delivery Policy and Return, Refund and Cancellation Policy, which form part of these Terms. If you do not agree, please do not use the Website. These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature.

2. Eligibility

• To place an order, you must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872.
• If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian, who must place the order.
• We currently accept orders only for delivery to addresses within India.

3. Your Account

• An account is created for you when you place an order, and we email you a link to set your password. Please provide accurate, current and complete information.
• You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.
• We may suspend or close an account that breaches these Terms, provides false information or is involved in fraudulent activity.

4. Product Information and Colour Variance

• We try to describe and photograph our products as accurately as possible. Actual colours may vary slightly from what you see because of screen settings, lighting and the printing process.
• Minor variations in print placement, shade and measurements are normal for printed apparel and are not considered defects.
• Please check the size chart and product description on each product page before ordering.

5. Pricing and Availability

• All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Delivery charges, discounts and the final amount payable are shown at checkout before you pay.
• Prices, offers and product availability may change without notice. The price that applies to your order is the price shown at checkout when you place the order.
• All products are subject to availability. If an item is listed at an incorrect price or with incorrect information because of a typographical or technical error, we may cancel the order and refund any amount paid, even after you have received an order confirmation.

6. Orders, Acceptance and Cancellation

• After you place an order, you will receive an order confirmation by email. This confirms that we have received your order; it is not our acceptance. Your order is accepted when we dispatch it.
• Cancellation by you: you may cancel your order at any time before it is dispatched by contacting us with your order number. Once an order has been dispatched it cannot be cancelled, but you may request a return under our Return, Refund and Cancellation Policy.
• Cancellation by us: we may refuse or cancel an order (in full or in part) if the product is out of stock, there is a pricing or listing error, we suspect fraudulent or unauthorised activity, the delivery address is not serviceable, or we cannot verify the order or contact you.
• If a prepaid order is cancelled by you before dispatch, or by us, we will refund the full amount paid to the original payment method.

7. Payments

• Prepaid orders: online payments are processed securely by our payment partner Cashfree Payments, using UPI, debit/credit cards, net banking and wallets as enabled at checkout. We do not collect or store your full card number, CVV, UPI PIN or net banking password.
• Payments are also subject to the terms of Cashfree Payments and your bank. We are not responsible for a payment that is declined or fails because of your bank, card issuer or the payment network. If money is debited but your order is not confirmed, it is usually reversed automatically by your bank or the payment gateway; please contact us with the transaction details if it is not.
• Cash on Delivery (COD): COD is available for eligible pin codes and orders up to ₹1,500, at our discretion. To confirm a COD order you pay a ₹49 confirmation payment online (via Cashfree Payments); the confirmation payment is part of your order total and the balance is paid in cash at delivery. There is no separate COD delivery charge. The confirmation payment is a non-refundable payment that covers handling charges, except where the order is cancelled by us or cannot be delivered; on a return we refund the order total minus the confirmation payment. Please keep the balance amount ready at the time of delivery.
• Refusing to accept COD parcels without a valid reason, or repeatedly placing COD orders that are not accepted, causes losses to us. In such cases we may disable COD for your account, phone number or address and require prepayment for future orders.
• Current delivery offer: delivery is free on every order; prepaid orders also get flat ₹49 OFF on orders up to ₹999 (orders above ₹999: 10% OFF with code HS10), and COD orders pay a ₹49 confirmation payment online with the balance at delivery. Offer terms may change at any time, and the amount shown at checkout applies.

8. Offers and Coupons

• Discounts, coupons and promotional offers are subject to their specific terms, cannot be exchanged for cash, and may be changed or withdrawn at any time.
• We may cancel an order or withdraw a benefit if an offer is misused or obtained through fraudulent means.

9. Shipping and Delivery

Orders are shipped across India through our delivery partner Delhivery. Delivery timelines are estimates and may vary. Please read our Shipping and Delivery Policy for processing times, delivery charges, tracking and delivery attempts. You are responsible for providing a complete and correct delivery address and phone number.

10. Returns, Refunds and Exchanges

Eligible products can be returned within 7 days of delivery. Please read our Return, Refund and Cancellation Policy for conditions, exclusions, refund methods and timelines.

11. Intellectual Property

All content on the Website, including the Half Skull / Halfskull name and logo, product designs, artwork, photographs, graphics and text, is owned by or licensed to HALFSKULL APPARELS LLP and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, sell or use any of it for commercial purposes without our prior written permission.

12. User Conduct

When using the Website, you agree not to:

• provide false information, impersonate anyone, or place fake or fraudulent orders;
• use another person’s payment method without authorisation;
• interfere with the Website’s security or operation, or introduce viruses or other harmful code;
• use bots, scrapers or other automated tools to access or copy the Website;
• post content that is unlawful, defamatory, obscene, hateful, infringing or misleading; or
• use the Website for any unlawful purpose or any purpose prohibited by these Terms.

13. Reviews and User Content

• Reviews, ratings, photos and other content you submit must be honest, based on your genuine experience, and must not contain offensive or unlawful material or other people’s personal information.
• By submitting content, you grant HALFSKULL APPARELS LLP a non-exclusive, royalty-free licence to use, reproduce and display it in connection with the Website and the Halfskull brand.
• We may moderate, decline or remove any content that breaches these Terms.

14. Third-Party Services and Links

The Website uses third-party services (such as payment, delivery and analytics providers) and may link to third-party websites. We are not responsible for the content, policies or practices of third parties, and your use of their services is subject to their own terms.

15. Limitation of Liability

• The Website is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted or error-free.
• To the maximum extent permitted by law, HALFSKULL APPARELS LLP will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the Website or our products.
• Our total liability for any claim relating to an order will not exceed the amount you actually paid for that order.
• Nothing in these Terms limits any rights you have as a consumer under the Consumer Protection Act, 2019 or other applicable law.

16. Indemnity

You agree to indemnify and hold harmless HALFSKULL APPARELS LLP, its partners, employees and service providers against any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.

17. Force Majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, extreme weather, epidemics, fire, floods, strikes, riots, government orders, network or power failures, and disruptions at our courier or payment partners.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts at Hooghly, West Bengal shall have jurisdiction over any dispute arising out of or relating to these Terms or your use of the Website.

19. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, you may contact our Grievance Officer with any complaint about our products, orders or the Website:

Please include your order number and details of the issue. We will acknowledge your complaint within 48 hours and resolve it within one month from the date of receipt. If you are not satisfied with our response, you may also contact the National Consumer Helpline (1915 or consumerhelpline.gov.in) or approach the appropriate Consumer Commission.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Website after changes are posted means you accept the updated Terms. Orders already placed are governed by the Terms in force when the order was placed.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right.
